Bungie is being sued, this time by sci-fi creator Matthew Kelsey Martineau who publishes underneath the pen identify Caspar Cole.
Martineau’s lawsuit (noticed by TheGamePost) claims that Bungie “intentionally and deliberately” copied his work for the story line of Future 2’s Purple Warfare marketing campaign.
He’s calling Bungie out for copyright infringement, saying that his character Yinnerah, chief of the Purple Legion in his personal revealed works, was copied within the creation of Future 2 character Dominus Ghaul.
Martineau factors to similarities between the characters origins and motivations, whereas additionally calling out different similarities between his Purple Legion and Bungie’s Purple Legion Cabal.
The lawsuit states that “The similarities between Martineau’s major antagonist, Yinnerah, and Future 2’s major antagonist, Dominus Ghaul, are hanging and clearly set up greater than a mere coincidence.”
“The rise of Dominus Ghaul from Future 2 replicates the rise of Overlord Yinnerah from Martineau’s work; they’re each urged, guided, and assisted by outcast mentors (students) to overthrow their leaders to rise to energy with the intentions of invading Earth. In each Martineau’s work (together with, with out limitation, “The First Protection”) and Future 2, rebels fend off Purple Legion invaders on Earth towards backdrops of burning settlements, ravaged streets, and utter chaos.”
As recompense for this alleged infringement, Martineau is in search of courtroom orders for “Defendants to ship to Martineau all copies of supplies that infringe or violate any of Martineau’s rights described herein,” and “Requiring Defendants to supply Martineau with an accounting of any and all gross sales of services or products that infringe or violate any of Martineau’s rights, as described herein.”
Martineau additionally desires the case to go to trial, and is asking for a jury trial to settle the case. Bungie has but to reply to the lawsuit or launch a public assertion in response to it.
